Terms of Use

These Terms of Use ("Terms") govern your access to and use of the BeyondTest test management service (the "Service") provided by [Company Legal Name] ("BeyondTest", "we", "us"). By accessing or using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization.

The Service

BeyondTest provides test management, requirements, and AI-assisted features. We may update, add, or remove features over time. Some features rely on third-party providers (see our Privacy Policy).

Accounts and eligibility

You must provide accurate information, keep your credentials secure, and are responsible for activity under your account. You must be at least 16 years old. The first user on an instance becomes its administrator and is responsible for managing access.

Trials and subscriptions

We may offer trials and paid plans. Trial instances are provided as-is and may be suspended or removed at the end of the trial period. Fees, seat counts, and billing terms for paid plans are as agreed in an order or plan selection. Unless stated otherwise, fees are non-refundable.

Your content and data

You retain all rights to the data you create or import ("Your Content"). You grant us a limited license to host, process, and display Your Content solely to provide the Service. You are responsible for Your Content and for having the rights to use it, and for not uploading unlawful, infringing, or sensitive data you are not permitted to process.

AI features

AI features generate suggestions (test cases, plans, scripts, reviews, release notes, and similar) that may be inaccurate or incomplete. They are assistive only and are presented for your review — you are responsible for reviewing and approving any output before relying on it. AI output is not professional advice.

AI features are optional and rely on third-party AI providers (Anthropic, OpenAI, or Google, as selected by your instance administrator). Content you submit to an AI feature is transmitted to and processed by that provider under its own terms, security practices, and privacy policy, which we do not control and for which we are not responsible. Where the Service is configured with your own API key, your use of the provider is governed solely by your agreement with that provider.

You are responsible for the content you submit to AI features, including ensuring you have the right to process any personal data it contains and that such processing complies with applicable law and your organization's policies. Do not submit personal data, credentials, or regulated data to AI features unless your organization has approved doing so with the selected provider. To the maximum extent permitted by law, we disclaim all liability for security incidents, data handling, retention, or privacy practices of AI providers, and for any loss or claim arising from content you elect to submit to AI features or from your use of AI output.

Acceptable use

You agree not to: misuse or disrupt the Service; attempt to gain unauthorized access; reverse engineer, resell, or use the Service to build a competing product; upload malware; or violate applicable law or others' rights.

Intellectual property

The Service, including its software, design, and content (excluding Your Content), is owned by BeyondTest and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service per these Terms. "BeyondTest" and related marks are our trademarks.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

Limitation of liability

To the maximum extent permitted by law, BeyondTest will not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, or revenue. Our total liability for any claim relating to the Service will not exceed the amounts you paid us in the twelve months before the claim (or, if you use a free trial, USD $100).

Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or as needed to protect the Service. Upon termination, your right to use the Service ends; sections that by their nature should survive will survive.

Governing law

These Terms are governed by the laws of [State/Country], without regard to conflict-of-laws rules. Disputes will be resolved in the courts located there, unless otherwise required by applicable law.

Changes

We may update these Terms; we will post the new version here and update the date above. Continued use after changes take effect constitutes acceptance.
